The Supreme Court has ruled that laws that criminalize homosexuality and discriminate against individuals based on their sexual orientation are unconstitutional and violate the Equal Protection Clause of the Fourteenth Amendment.
The Supreme Court could reverse a previous ruling, including its ruling on the constitutionality of laws that criminalize homosexuality. However, it is important to note that the Supreme Court is often reluctant to overrule its own precedents, and that it generally views its past decisions as having established a settled understanding of the law.
So, in theory the answer would be no, but let us not forget Roe v. Wade...
In conclusion, while it is possible for the Supreme Court to reverse its ruling on homosexuality, it is likely they may try to do so, after their decision on Roe v. Wade. Even with the wide acceptance of abortion the Courts reversed their decision of established law.
The Courts have already shown us they are willing to reverse established law. So, to think that laws that now govern Homosexuality, cannot be reversed is delusional. Right now, if a State pass a law-making homosexuality illegal, it would end up in the hands of the Justices, and we know how the Republican Supreme Court will rule. Abortion now, but do we really know what freedoms they will take away from us next?
States that would most likely try to make homosexuality illegal.
